If that line of reasoning holds up in one instance, it should hold up in the other (again, putting the legalities aside for the moment).

Now if it were me, and this had been a legal spy shot I had taken, I would have photo shoped it as a best guess the way Hot Rod Mag did to what the finished product would be.
